Overview

We operate this online store and website, including all related information, content, features, tools, products and services (the "Services"). The Services are hosted on the Shopify platform.

These Terms of Service, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy, set out your rights and obligations when you use the Services. Those policies form part of these Terms.

By accessing, browsing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.


1. Your rights as a consumer

If you are in New Zealand and buying for personal, domestic or household use, you are protected by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

Nothing in these Terms excludes, restricts or modifies those rights. Where any provision of these Terms conflicts with those Acts, those Acts prevail and the provision does not apply to you.

If you are acquiring goods for the purposes of a business, and we agree in writing that the Consumer Guarantees Act does not apply, then it does not apply to that transaction. This is the only circumstance in which those guarantees are excluded.


2. Access and account

You confirm that you have reached the age of majority in your country of residence.

You are responsible for the accuracy of the information you provide and for keeping your account secure. Accounts may not be transferred or assigned.


3. Products and how they are shown

We take care to present our products accurately. Colours and appearance may vary depending on your screen or device.

Product descriptions must be accurate, and we do not make claims about our products that are not true. If a product you receive does not match its description, our Returns & Refunds Policy applies.


4. Orders

Placing an order is an offer to buy. A contract is formed only when we confirm your order and your payment is successfully processed.

We may decline or cancel any order — for example, where a product is unavailable, where there has been a pricing error, or where we suspect fraud. If we cancel an order after payment, we refund you in full.

You may cancel your order at any time before it is dispatched. See our Returns & Refunds Policy.


5. Prices and payment

All prices are displayed in New Zealand dollars and are the final price of the product. Any applicable New Zealand GST is included in the displayed price where we are registered for GST; our Shipping Policy explains our current GST status and how customs charges may apply to higher-value orders.

Shipping costs, where they apply, are shown at checkout before you pay.

We may change prices at any time, but the price that applies to your order is the price displayed when you placed it.

You must provide accurate and current payment details.


6. Shipping, delivery and risk

Our Shipping Policy sets out processing times, estimated delivery times and how we handle delays and lost parcels.

Estimated delivery times are estimates and not guarantees. Carrier delays, customs processing and events outside our reasonable control may extend them.

Risk of loss and damage remains with us until the product is delivered to you. If your order is lost, damaged in transit, or does not arrive within a reasonable time, we will replace it or refund you in full, as set out in our Returns & Refunds Policy.


7. Returns and refunds

Our Returns & Refunds Policy forms part of these Terms. In summary: we do not accept returns for change of mind. If a product is faulty, damaged, incorrect or not as described, you are entitled to a remedy at no cost to you, and you do not need to return the product.


8. Intellectual property

All content on the Services is owned by us or our licensors and is protected by law. You may not reproduce, distribute or commercially exploit it without our written permission.


9. Third-party tools and links

Third-party tools are provided as they are, without warranty, to the extent permitted by law. Nothing in this section limits your rights under the Consumer Guarantees Act.

We are not responsible for the content or practices of third-party websites you reach through the Services. You access them at your own risk.


10. Shopify

The Services are hosted by Shopify. All transactions are between you and James Wellington. Shopify is not a party to your purchase and accepts no responsibility for it.


11. Privacy

We handle personal information in accordance with our Privacy Policy, the New Zealand Privacy Act 2020 and the EU General Data Protection Regulation.


12. Reviews and submissions

If you submit a review, comment or other content, you grant us a non-exclusive, royalty-free right to use it for commercial and promotional purposes.

We do not publish fake reviews, edit reviews to change their meaning, or offer payment or benefits in exchange for favourable reviews.

You are responsible for what you submit. We may remove content that is unlawful, abusive or misleading.


13. Errors and omissions

The Services may occasionally contain errors in descriptions, pricing, availability or delivery times. We may correct them and cancel or amend affected orders.

If a pricing error means you were charged more than the correct price, we refund the difference. If it means you were charged less, we may cancel the order and refund you in full — we will not require you to pay more.


14. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Services.

This section does not apply to the extent that it would exclude or limit your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot lawfully be excluded.


15. Complaints and disputes

If something goes wrong, contact us first at info@jameswellington. We would rather resolve it directly.

If we cannot, you may contact the Commerce Commission (0800 943 600, comcom.govt.nz) or bring a claim in the Disputes Tribunal (disputestribunal.govt.nz).


16. Governing law

These Terms are governed by the laws of New Zealand in respect of any purchase made by a consumer in New Zealand, and the New Zealand courts and the Disputes Tribunal have jurisdiction.

Where you are resident in the European Union, you retain the protection of the mandatory consumer law of your country of residence.


17. Changes to these Terms

We may update these Terms from time to time. The current version is always available on our website, with the date it was last updated. Changes do not apply retrospectively to orders already placed.
